1. Agreement to Terms

By accessing or using thedrugclub.com or any services provided by TheDrugClub Inc. ("TheDrugClub," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Eligibility

You must be at least 18 years of age and a legal resident of the United States to create an account and use our services. By using our services, you represent and warrant that you meet these requirements.

3. Membership and Billing

• Plans: The Single Plan is $19.95/month and covers one individual. The Family Plan is $29.95/month and covers all household members.
• Billing cycle: Membership fees are charged monthly on your billing date. By enrolling, you authorize us to charge your payment method on a recurring monthly basis.
• Risk-Free Trial: If offered, your card is validated at enrollment but not charged until the trial period ends. Cancellation before the trial ends will not result in a charge.
• Price changes: We will notify you at least 30 days in advance of any price increases, which take effect at your next billing cycle after the notice period.
• Failed payments: If a payment fails, we will attempt to re-process and notify you. Continued failure may result in service suspension.

4. Prescription Services

• All medications require a valid prescription from a licensed healthcare provider. TheDrugClub does not prescribe medications.
• We will make reasonable efforts to transfer your prescriptions from your current pharmacy, but cannot guarantee transfer in all circumstances.
• Covered medications are listed in our formulary, which may be updated. Not all medications are covered.
• We are not responsible for delays caused by your prescribing provider, your current pharmacy, or third-party shipping carriers.

5. Cancellation and Refunds

You may cancel your membership at any time by contacting us at support@thedrugclub.com or calling (424) 375-7114. Your membership will remain active through the end of the current billing period. We do not offer prorated refunds for partial months. Refund requests for extenuating circumstances are reviewed on a case-by-case basis.

6. Prohibited Uses

You agree not to:

• Use our services for any unlawful purpose
• Submit false or fraudulent prescription information
• Share your membership credentials with individuals outside your household
• Attempt to reverse engineer, scrape, or disrupt our platform
• Impersonate another person or entity

7. Medical Disclaimer

TheDrugClub is a pharmacy benefit service, not a medical provider. Nothing on our website or in our communications constitutes medical advice. Always consult your physician or licensed healthcare provider before starting, stopping, or changing any medication.

8. Limitation of Liability

To the maximum extent permitted by law, TheDrugClub shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claim arising out of or relating to these terms shall not exceed the total fees you paid us in the three months preceding the claim.

9. Intellectual Property

All content on thedrugclub.com, including text, graphics, logos, and software, is the property of TheDrugClub Inc. or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Los Angeles County, California.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes via email or a prominent notice on our website. Continued use of our services after changes take effect constitutes your acceptance of the revised terms.
